These official rules govern the conduct of the raffle.  By purchasing a raffle ticket, you agree to be bound by these rules and the decisions by the Autism Society of Santa Barbara (“ASASB”), which shall be final.  State of California Non-Profit Raffle Registration # R-5568.

Eligibility:  Raffle Ticket buyers must be California residents 18 years of age or older.  Winner need not be present at time of drawing to win.  An affidavit of eligibility will be required from prizewinners.  ASASB Employees, Board members, and members of their immediate families are not eligible to participate.

Entry:  A maximum of 1000 tickets will be sold.  At least five prizes will be awarded.  The IRS has taken the position that amounts paid for chances in raffles, lotteries or similar drawings for valuable prizes are not gifts and therefore do not qualify as tax deductible charitable contributions.  Raffle participants and prizewinners agree that ASASB will be able to use their name and/or likenesses for media advertising/announcements/presentations including television, radio, web and print.  The list of winners will be published on ASASB’s website.

Ticket Orders: Tickets are $25.00 each, and may be purchased from ASASB.  You may buy as many tickets as you wish subject to availability.  To order tickets:  Please make check payable to ASASB and send entry form by mail to ASASB PO Box 30364, Santa Barbara, CA 93130.  Or register online at www.asasb.org and pay with Paypal.   ASASB will reject any raffle ticket order if payment is not honored or rejected for any reason.  The ticket receipt(s) will be mailed to the ticket holder.

Refunds:   All raffle ticket sales are final.  ASASB assumes no responsibility for lost, late, misdirected or non-delivered mail or any other failure to receive orders or deliver receipts prior to the drawing deadlines.  A raffle participant’s sole and exclusive remedy for ASASB’s breach shall be limited to the return of the purchase price paid for his or her raffle ticket(s).  In no event shall ASASB, its directors, officers or employees, agents or representatives be liable to any party for any loss or injuries to earnings, profits or goodwill, or for any incidental, special, punitive or consequential damages of any person or entity whether arising in contract, tort or otherwise, even if advised of the possibility of such damages.

Prizes: All prizewinners will be called by name.  All prizes awarded are subject to tax withholding in accordance with applicable law.  If any winner cannot be located after reasonable attempts to do so by ASASB, or if any winner is deemed to be ineligible or does not otherwise claim his or her prize by 5:00 pm on the day that is 90 calendar days following the Grand Prize Drawing, such winner will be deemed to have forfeited his or her prize.  All forfeited prizes will go to ASASB.

ASASB, its board members, directors, officers, employees, agents, and representatives are not responsible for any injuries, losses or damages of any kind arising in connection with or as a result of a winner’s acceptance or use of any prize.  Each prize winner agrees to indemnify, defend and hold ASASB, its directors, officers, employees, agents and representatives harmless from any and all losses, damages, rights, claims and actions of any kind arising in connection with or as a result of such winner’s acceptance or use of any prize.  ASASB is not providing legal or tax advice to any contestant or winner, and all contestants and winners are strongly advised to consult professional legal and tax advisers prior to ticket purchase.

Drawings:  Early Bird, Second, Third and Fourth Prize winners will be eligible for the final Grand Prize of a 2007 Ford Focus.  All prizewinners will be announced on May 12th, 2007.

Additional Prizes: Entries postmarked by April 20th will be eligible for the Early Bird Prize of Santa Barbara Area Restaurant Gift Certificates (Value $500).
Second Prize an Ipod Nano value $200. Third Prize Gift Certificate value $100.  Fourth Prize Gift Certificate value $100.

Grand Prize Drawing:  Drawing will be held at the Mother’s Day 5/10k and Family Festival held at Goleta Beach at or around noon on May 12, 2007.  If less than 1000 tickets have not been sold by May 12, 2007, tickets may be purchased at the Mother’s Day festival on May 12, 2007 from 8am to 11am.  Mailed entries must be received by May 10, 2007.  Those paying via the website asasb.org through PayPal must have posted the funds by May10, 2007.

Prize Details:  If the ticket holder wins the 2007 Ford Focus they need to be aware that the prize does not include premiums for any public liability or property damage insurance coverage.  GPW will make arrangements with Mel Clayton Ford, 350 Hitchcock Way, Santa Barbara, CA 93105, (805)898-0800 to take possession of the car. The winner will also be liable for any federal and/or state taxes and licensing.

Prize awards in the event of non-sellout of tickets.  In the event that at least 800 tickets are not sold by 11:00am May 12th, 2007, the 2007 Ford Focus will be excluded from the Grand Prize Drawing and the GPW will be awarded a cash prize computed as 50% of net raffle proceeds.  The net proceeds will be divided equally between ASASB and GPW based on ASASB’s accounting, which shall be final and conclusive with respect to the GPW.
